Beginning in the 1960s, small local governments started to regulate commercial signage. Regulations expanded over the course of the next few decades, with the strictest rules in suburban areas and the most relaxed ones in urban areas. Today, many municipalities have rules dictating the size, type, number and location of signage. Even today, many towns do not allow for businesses to install digital signage or electronic message boards.

What Does the Law Have to Say?

Several businesses have sued cities and states over their right to post signage. The Supreme Court has ruled multiple times in favor of commercial enterprises. Local governments need to demonstrate that their signage rules are reasonable and well thought-out. At the end of the day, as long as your sign is not preventing the flow of pedestrian or automobile traffic, you may be able to defend it in court. Many cities have regulations that require signs to not contribute to visual clutter, to not detract from the scenic nature of their surroundings and to preserve the aesthetics of the surroundings.
